Welcome to the Local Hem, LLC (“Local Hem”) web site, which is located at http://www.localhem.com (the "LH Site"). The following privacy policy outlines the efforts of Local Hem as it relates to the privacy of users (this “Policy”). This Policy describes your rights and responsibilities and what you can expect when using the LH Site as it relates to your information. If you do not read, understand, and agree to all of the terms and conditions listed in this Policy, you may not use the LH Site or any of Local Hem’s services.

Local Hem reserves the right to add to, delete or change this Privacy Policy at any time. As such, you should check this Privacy Policy from time to time for such changes.


2. What This Privacy Policy Covers
This Policy is a part of the terms and conditions of use which govern the LH Site. It covers how Local Hem treats personally identifiable information, such as your name, address, email address, telephone number, and like information (the “Personal Information”). Local Hem uses secure third-party service providers that collect payment and billing information (the “Payment Information”).

This Privacy Policy is a part of Local Hem’s terms and conditions of use. Accordingly, when you access or use the LH Site or use any of Local Hem’s services, and/or when you engage in transactions through the LH Site and with its Retail Partners, you agree that Local Hem may collect, use and disclose your information in accordance with this Policy.


3. Use of Personal Information; Information Sharing and Disclosure
Local Hem does not sell, rent, trade, publish or share any data received from you, including Personal Information or Billing Information, unless otherwise detailed in this Policy, to comply with any law, to provide a Local Hem service, in order to process transactions made through the LH Site, or to protect Local Hem’s rights.

Local Hem receives and may record information on our server logs from your browser, including your IP address, cookies, and the page you request in order to better operate the LH Site. Local Hem may use analytic tools or services to view aggregate statistics about the usage of various aspects of the LH Site. We use both your Personal Information and certain non-personally-identifiable information, such as anonymous user usage data, browser type, clickstream data, and others, to improve the quality and design of the LH Site and to create new features, functionality, and services.

Local Hem does not use your email address or other personally identifiable information to send marketing messages unless you’ve opted-in to receive such messages. You may choose to receive updates from Local Hem and/or from individual Retail Partners. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major LH Site changes or for customer service purposes).

You are hereby advised that any Personal Information or content that you voluntarily disclose online (on message boards, in reviews and discussion areas, etc.) becomes publicly available and can be collected and used by others. If you post Personal Information online that is accessible to the public, you may receive unsolicited messages from other parties in return. As previously stated, Local Hem does not rent or sell your Personal Information.

Local Hem may share Personal Information about you under the following circumstances: (i) Local Hem may be required to disclose Personal Information under special circumstances, such as to comply with subpoenas, warrants, court orders or legal process, or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright Law), or to establish or exercise our legal rights or defend against legal claims; (ii) it may be necessary to share information in order to investigate, prevent, or take action regarding suspected or actual illegal activities, including without limitation, fraud, situations involving potential threats to the physical safety of any person, violations of Local Hem's terms and conditions of use, or as otherwise permitted or required by law; (iii) Local Hem will transfer information about you if Local Hem is acquired by or merged with another company, in which case Local Hem will notify you by email or by prominent notice on the LH Site before information about you is transferred and becomes subject to a different privacy policy; and (iv) Local Hem may share demographic information with its Retail Partners.

Additionally, Local Hem reserves the right to disclose Personal Information and/or non-personally-identifiable information that Local Hem believes, in good faith, is appropriate or necessary to enforce the Local Hem terms and conditions of service, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the LH Site, and to protect the rights, property, or personal safety of Local Hem, our users or others.


4. Collection of IP Addresses
IP Addresses are automatically reported by your browser each time you view a web page. IP addresses may be used for various purposes, including: (i) to diagnose or service technology problems reported by our users or engineers that are associated with the IP addresses controlled by a specific web company or ISP; (ii) to tailor advertising based on geographic area or other information derived from your IP address (aggregate information derived from IP addresses may also be reported to advertisers); to estimate the total number of users visiting the LH Site from specific geographical regions.


5. Use of Cookies

Local Hem may contract with various third parties who help us provide and maintain the LH Site or the Local Hem services. While using the LH Site, you may link to websites operated by our Retail Partners or other third parties. This does not mean that Local Hem endorses these websites. Local Hem does not make any representations or warranties about any website you may access through the LH Site. These other sites are independent from Local Hem, and Local Hem has no control over, or responsibility for, their information or activities.


7. Limitation of Access to Personal Information
Local Hem limits access to Personal Information about you to employees of Local Hem, and of the Retail Partners, who Local Hem believes reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs.


8. Data Security and Change of Control
Local Hem, through third party service providers, uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your Personal Information. Local Hem cannot, however, ensure or warrant the security of any information you transmit to Local Hem and you do so at your own risk. Once we receive your transmission of information, Local Hem, through third party service providers, makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If Local Hem learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Local Hem may post a notice on the LH Site if a security breach occurs.

In the event that Local Hem is acquired by or merged with a third party entity, Local Hem reserves the right, in any of these circumstances, to transfer or assign the information Local Hem has collected from our users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, Local Hem may not be able to control how your Personal Information is treated, transferred, or used.
